GALAXY STORE IN-APP COUPON PROMOTION (“COUPON OF THE MONTH OFFER”)

TERMS AND CONDITIONS

Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at [https://gmp.samsungapps.com/promotion/20230825000530/index.html?t=prm&product=galaxystore] form part of the Terms and Conditions.

The Promoter

1. Samsung Electronics Canada Inc., 2050 Derry Road West, Mississauga, ON, L5N 0B9

(the “Promoter” or “Samsung”).

Promotion Period

The Coupon of the Month Offer will commence at 00:00 (EST) on September 1^st, 2023 and will close at 23:59 (EST) on December 31^st, 2023 (the “Coupon of the Month Offer Period”).

Eligibility

Samsung Galaxy Coupon of the Month Offer (the "Coupon of the Month Offer") is open to individuals, who:

1. Are legal residents of Canada (excluding Quebec) ;

2. Are of the age of the majority in their respective province or territory in Canada;

3. (“Participant” or “You”).

4. Have a valid Samsung Galaxy Store account;

5. Employees, agents and any group company of the Promoter, and anyone professionally connected to this Coupon of the Month Offer, are not eligible to enter.

6. This Coupon of the Month Offer is only available to end users (e.g. not to any reseller or business) and is not available in conjunction with any other offer.

7. have created a Samsung Account (subject to the Samsung Account Terms & Conditions and Privacy Policy);

8. Participants may receiveone (1) Galaxy Store coupon (“Coupon”) per month, for a maximum of four (4) Coupons during the Coupon of the Month Offer Period per Samsung Galaxy Store account and per Samsung Galaxy device during the Coupon of the Month Offer Period; and

9. Participant must have one of the devices set out in Schedule 1 (each a “Compatible Device”):

10. Participants must have a Samsung Galaxy Store account in order to participate in this Coupon of the Month Offer.

11. The Coupon of the Month Offer will be divided into four rounds whereby Participants can receive a Coupon per Samsung Account per Compatible Device in time period set out below..

12. The Coupon that will given to 10,000 Participants on a first-come, first-served basis for each Time Period. . The Coupon can only be used for one in-app purchase of games downloaded from the Galaxy Store. The Time Period, quantity of available Coupons and the value of each Coupon are set out below.

13. For each Time Period specified above, a Participant can immediately receive one (1) Coupon on a first-come, first-served basis when
(i) the Participant goes to the Galaxy store,
(ii) sees the “Get Coupon” button in the Galaxy store,
(iii) agrees to these Terms and Conditions of this Coupon of the Month Offer, and
(iii) clicks on the “Get Coupon” button in the Galaxy Store Events page.
Participants may review the Terms and Conditions in advance which will be found at the bottom of the Coupon of the Month Offer page or review the Terms and Conditions during the Coupon of the Month Offer consent process identified above.

14. The Coupon can only be used for a single purchase transaction within the Galaxy store. Any remaining amount that is not used is not exchangeable for cash or another discount coupon and will automatically be forfeited.

15. The Coupon is non‐transferable and there is no cash alternative. In the event of unforeseen circumstances, the Promoter may substitute a reward of equal or greater value for the Coupon.

16. If Participants change and/or disable their Samsung Galaxy Store Account, they will not be able to redeem any Coupon or in-game credit earned under the original account

17. Participants will only be required to agree to these Terms and Conditions of the Coupon of the Month Offer only once for the entire duration of the Coupon of the Month Offer Period, regardless of which Time Period they participate in.

18. In each Time Period, if the maximum Coupon quantity of 10,000 is exhausted, no more Coupons for this Time Period will be available.

How to claim

1. To get a Coupon, a Participants must do the following:

a. During the Coupon of the Month Offer Period, a Participant must:

i. Log into your Samsung Galaxy Store Account;

ii. See the “Get Coupon” button in the Galaxy Store Events page

iii. Review and agree to these Terms and Conditions

v. Click the “Coupons button” to see the Coupon.

b. If there is a message about “No more Coupon” at the end of the first Time Period or the second Time Period, as applicable, Participants must wait to the next available Time Period to obtain a Coupon.

2. Each Coupon expires seven (7) days after it has been delivered to the Participant in their Samsung Galaxy Store Account (the “Coupon Expiry Date”). Any Coupon used/redeemed after the Coupon Expiry Date will not be accepted.

3. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of the Coupon.

4. The Promoter reserves the right at its absolute discretion to disqualify any Participant which it considers does not comply with these Terms and Conditions.

General

Force Majeure: The Promoter shall not be liable for any interruption to the Coupon of the Month Program, whether due to force majeure or other factors beyond the Promoter’s control.
Amendments to the Terms and Conditions: The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary, amend or terminate the Terms and Conditions of the Coupon of the Month Program.
Verification of Eligibility: Eligibility for the Coupon is subject to verification. Promoter may delay the granting or redemption of the Coupon for the purposes of investigation. Promoter may also refuse to verify and process any transaction Promoter deems, in its sole discretion, to be fraudulent, suspicious, in violation of these Terms and Conditions, or believes will impose potential liability on Promoter, its subsidiaries, affiliates or any of their respective officers, directors, employees, representatives and agents. All of Promoter’s decisions are final and binding, including decisions as to whether the Coupon is verified or should be granted or redeemed.
Exclusion of Liability: The Promoter will not be responsible or liable for: (a) any failure to receive claims due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions of claims or Coupon(s); (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; (e) any printing or typographical errors in any materials associated with the Coupon of the Month Program; or (f) any use of the Coupon by persons under the age of majority in their respective Province or Territory in Canada.
Sales Taxes: Participants will be solely responsible for any and all applicable sales or other taxes and any other relevant costs, expenses which are not stated in the Terms and Conditions as being included.
Release: By receipt of the Coupon, Participant agrees to release and hold harmless Sponsor, and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion, agents, and offer suppliers, and each of their respective parent companies and each such entity’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Offer or receipt or use or misuse of the Coupon.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Offer, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Offer, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Offer or to be acting in violation of these Terms and Conditions in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Offer may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
Limitation of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Offer; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the operation of the Offer; (4) technical or human error which may occur in the administration of processing the Coupon or the processing of Qualifying Purchases of Participants; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Offer or receipt or use or misuse of any Coupon.

IN NO EVENT SHALL RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES OR LOST PROFITS, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS MEANS THAT PARTICIPANT HEREBY WAIVES ANY AND ALL RIGHTS TO ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES OR LOST PROFITS FROM THE RELEASED PARTIES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SPONSOR’S AND THE RELEASED PARTIES’ CUMULATIVE LIABILITY TO PARTICIPANT ARISING FROM ANY CAUSE OF ACTION WILL AT ALL TIMES BE LIMITED TO THE LESSER OF (A) YOUR ACTUAL LOSS; OR (B) $1,000. THE FOREGOING DISCLAIMERS, EXCLUSIONS AND LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

Disputes: Except where prohibited, Participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Offer or any Samsung Coupons shall be resolved or settled by the Courts of the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participant and Released Parties in connection with the Offer, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
Participant's Personal Information: The Sponsor is collecting personal information about you for the purpose of administering this Coupon and for any other ground permitted under these Terms and Conditions. Your personal information will be used for the administration of the Coupon and in aggregated, non-personal form in order to create reports regarding Participant demographics and consumer habits, which reports the Sponsor may disclose to others. You consent to the collection, use, storage, sharing and disclosure by the Sponsor and its officers, directors, employees, agents or representatives of the personal information provided by you accordance with the privacy policy associated with creating the Samsung Account (Samsung Account) and these Terms and Conditions.
